يعد غفلة الناس عن تعاليم دينهم الذي ضمن لهم عيشهم بأمان لجنوا إلى نظم وضعية مختلفة، ظانين أنها تحقق لهم الأمن المنشود، ومن بين تلك الأنظمة، نظم التأمين الوضعية صد المخاطر المختلفة، المبنية أساساً على فكرة التعاون بين عدد كبير من الناس لمواجهة آثار المخاطر، بالأسلوب المتمثل بــ (عقود التأمين التجاري)، المبنية على أسس قانونية وآليات عمل فنية، وهي ما لفتت أنظار الباحثين المسلمين، فتباينت أراؤهم حولها، لذلك جاء هذا الكتاب ليبحث مؤلفه أولاً عقد التأمين في أطره القانونية والواقعية والإقتصادية، بإعتباره نظرية عامة ذات قواعد فنية يقوم عليها نظام التأمين بفكرته وطريقته الإقتصادية والإجتماعية، ثم عقد التأمين الذي ينشئ حقوقاً وإلتزامات يلتزم بها أطرافه ويوضع بموجبها نظم التأمين موضع التطبيق ثانياً.
ثم عرض بالتفصيل الإتجاهات المتباينة للباحثين المسلمين في التأمين التجاري مع أدلة كل إتجاه منها، ثم حاول تقديم البديل الإسلامي للتأمين التجاري المعمول به، وذلك من خلال المنهج الذي قدمته شركات التأمين الإسبلامية القائمة فعلاً.
ويسر دار العصماء أن تنشر هذا الكتاب المهم الذي تكاملت به سلسلة الحلقات البحثية للإقتصاد الإسلامي، وجدير بالذكر أن أصل هذا الكتاب هو أطروحة الدكتوراه للمؤلف بإشراف الأستاذ العلامة الدكتور هاشم جميل عبد الله نال الشهادة فيها بتقدير إمتياز، عسى أن يجد القارئ مراده وينتفع به ذوو الإختصاص في المعاملات المالية في العلوم الإسلامية وأنظمة التأمين غير الإسلامية أيضاً لتفيد من تجارب الشركات الإسلامية أيضاً لتفيد من تجارب الشركات الإسلامية التي أثبتت نجاحاً كبيراً وثقة عند عموم الناس ولا سيما في الدول الأوروبية.
