موضوع المحاماة من المواضيع ذات أهمية كبرى في باب الحقوق، وهي نوع من الوكالة الّتي شرّعت لها الأحكام الخاصة في الدين الإسلامي القيّم، وغير خفي على من اطلع على مباني الشريعة ومعارفها أن الوكالة أعم من المحاماة من وجه، وللمحاماة آثار كثيرة ومتعددة في المجتمع الإنساني مادية ومعنوية، حقيقة وحقوقية، نوعية وشخصيّة، علمية وعملية، والمحامي يتحمل مسؤولية الدفاع عن الموكل وهو أمر خطير جداً وليس بسهل، لكونه أميناً على ما وكل، وأداء الأمانة والوفاء بالعهد والعقد مما استقل به العقل قبل النقل، والإعتبار قبل الشرع، والمحامي إذا قصّر في أداء المسؤولية الموجّهة إليه من قبل الموكل فهو ضامن لدى القانون وآثم عند الشرع فيعاقب في الدنيا قبل الآخرة، وأما إذا أدى وظيفته حسب الإتفاق والقرار بينه وبين الموكل فهو مأجور في الدنيا ومثاب في الآخرة إذا كان مؤمناً.
