كما أن القانون وسيلة لإدراك غاية، فإن هذه الغاية لابد من منطق يحكمها، من حيث النشأة والتكوين والتطور والتطبيق. فالقانون العادل والقانون المحقق للمصلحة العامة والقانون المحقق للإستقرار والأمن، إذا لم يكن مبنياً على منطق قانوني دقيق، فكف أن يكون قانوناً عادلاً، وكف أن يكون قانوناً محققاً للمصلحة العامة، وكف أن يكون قانوناً محققاً للإستقرار القانوني، ولقد أصبح البحث في المنطق القانوني، من الأمور التي تلقى اهتماماً من قبل علماء القانون وعلماء المنطق، وعلم المنطق القانوني وثيق الصلة بفلسفة القانون. وهكذا فإن هذا البحث يدور حول إيضاح دور المنطق القانوني في تكوين القانون وتطبيقه، وهو بهذه المثابة يتناول جوانب المنطق القانوني على مستوى تكوين القانون من ناحية المضمون والمنهج، كما يشمل كيف يساهم المنطق في تطبيق القانون، وهذا يتعلق بأساسيات الاستدلال القانوني والمنطق القضائي، لأن الاستدلال هو جوهر المنطق، وسنقسم دراستنا هنا على النحو التالي: (الفصل الأول: المنطق القانوني وفكرة القانون، الفصل الثاني: المنطق القانوني واللغة القانونية، الفصل الثالث: المنطق القانوني والمنهج التشريعي، الفصل الرابع: الاستدلال القانوني).
