مع التطوّر المتزايد والمتسارع في سوق المعاملات التجارية، ونظراً لحاجز المسافة والزمن بين طرفي المعاملة، كان لا بدّ أن يزوّد الأفراد بوسائل تعاقد حديثة، تعمل على الإقتصاد في النفقات، وتسريع التعامل، وإبرام العقود في ثوان أو دقائق معدودات.
ولقد شهد العالم - جرّاء هذا التطوّر السريع في عالم الإتصالات - ظهور الوسائل الإلكترونية وإستخدامها في كافة المجالات، حتى أصبحت وسائل لا يمكن الإستغناء عنها لكلّ فرد في المجتمع الحديث، وفرضت نفسها على نطاق واسع، وصارت كثير من الإجراءات التعاقدية تتمّ من خلال الأنظمة الإلكترونية المحوسبة، بوصفها البديل العصري للتعاقد عن طريق المراسلة والبرقيات العادية، وذلك لإتسامها بالسرعة والدقة في إجراء العقود، وسهولة إثباتها بالطرق الإلكترونية، كالإثبات بالتوقيع الإلكتروني مثلاً، ولقد كان من نتاج هذا التقدم في مجال تكنولوجيا الإتصالات ظهور التجارة الإلكترونية.
وهذه الرسالة تهدف إلى بيان محاسن الدين العظيم، وإبراز مقاصد الشريعة من خلال البحث في مسائل التجارة الإلكترونية وأحكامها في الفقه الإسلامي، وتحقيقاً لهذا الغرض فقد جاءت هذه الرسالة في ثلاثة فصول وخاتمة: جاء الفصل الأول منها كمدخل للتعريف بها، من حيث إعطاء نبذة عن ظهورها وتطوّرها، وآلية التعامل بها، وتوضيح مفهومها، وتكييفها الفقهي، وإبراز أهميتها، وخصائصها، ومزاياها، وأشكالها، وواقعها في دول العالم الإسلامي عامة، والأردن خاصة، وذكر أهمّ مخاطرها ومعوّقاتها، وبيان حكمها الفقهي، ومقاصد الشرع في تشريعها، أمّا الفصل الثاني فقد تناول عقد التجارة الإلكترونية، من حيث مفهومه، وتوضيح أركانه، والآثار المترتبة عليه، وأخيراً جاء الفصل الثالث ليتناول الوسائل التي يصح الإعتماد عليها شرعاً في إثبات عقد التجارة الإلكترونية عبر الإنترنت.
وانتهى الكتاب بعد هذه الفصول إلى خاتمة احتوت على أهمّ نتائج المدرسة.
