ان أي مجتمع لا بد له من سلطة تنظم امره، وتدير شؤونه، وتسيطر على مختلف اوجه النشاطات التي يمارسها افراده، وتوجههم نحو الامور التي تعمل على تقدم المجتمع وتطوره، وتمنعهم من الامور التي تلحق الضرر بالمجتمع وتعمل على تاخرهم. وهذه السلطة هي السلطة السياسية العليا في الجماعة، فالمجتمع والسلطة امران متلازمان، ولا يمكن ان يوجد مجتمع متحضر بدون سلطة. والسلطة ليست امتيازاً شخصياً لفرد في الجماعة، وانما الدولة هي مستودع السلطة ومستقرها، وهي دائماً باقية، وان تغير اشخاص الحاكمين الذين يستخدمون تلك السلطة. ولهذا فان الحاكمين افراد عاديون ليست لهم امتيازات طبقية، ويمارسون السلطة باسم الجماعة وبرضاهم، لتحقيق النفع العام. وقد درسنا في هذا البحث مسؤولية رئيس الدولة في النظام الرئاسي وفي الفقه الاسلامي، وذلك لتقاربها من حيث وجود رئيس اعلى للدولة يتمتع باختصاصات واسعة، وعدم وجود هيئة او وزارة تعمل الى جانبه، محاولين معرفة مدى مسؤولية رئيس الدولة في كلا النظامين، ذلك لان الكثير من تطبيقات النظام الرئاسي في دول امريكا اللاتينية قد تحولت الى نظم دكتاتورية، مما دفع البعض الى القول بعدم مسؤولية رئيس الدولة سياسياً في النظام الرئاسي. في حين ذهب الكثير من المستشرقين الى القول بعدم مسؤولية رئيس الدولة في الفقه الاسلامي، ومشبهين النظام الاسلامي بالنظم الثيوقراطية التي ظهرت في الدول الاوروبية، وان الامة ليس لها مسائلة الرئيس عن اعماله. ولهذا سنحاول معرفة ان كان رئيس الدولة في النظام الرئاسي، وكذلك في الفقه الاسلامي، مسؤولاً عن اعماله ام لا، وايهما اكثر مسؤولية من الآخر، والوسائل التي يمتلكها الشعب لمساءلة الرئيس في كلا النظامين.
