الدراسة مقسمة إلى بابين, الباب الأول مخصص لمسؤولية رئيس الدولة في النظام الرئاسي (معتمداً الدستور الأمريك كتاب للدكتور مروان محمد محروس المدرس يعتمد على إمكانية المقارنة بين الفقه الدستوري (الإسلامي) والقانون الوضعي وإظهار نقاط الإتفاق والإختلاف بينهما في مسؤولية رئيس الدولة في النظام الرئاسي والفقه الإسلامي وذلك لتقاربهما من حيث وجود رئيس أعلى للدولة يتمتع باختصاصات واسعة.
الدراسة مقسمة إلى بابين, الباب الأول مخصص لمسؤولية رئيس الدولة في النظام الرئاسي (معتمداً الدستور الأمريكي و البرازيلي والفنزويلي نموذجاً), والباب الثاني مخصص لمسؤولية رئيس الدولة في الفقه الإسلامي مبيناً ومقارناً ما يماثلها في النظام الرئاسي.
أي أننا نجد في هذا الكتاب عرض للوسائل المعاصرة التي تحدد السلطة والمسؤولية في الدولة وعرضها على الشريعة الإسلامية وقياسها في ميزانها وإمكانية الأخذ منها ما لم يتعارض معها كونها في إطار نظام الحكم حددت الخطوط العامة لهذا النظام وتركت الأمور التفصيلية والجزئية, ذلك لكي تكون قادرة على مواكبة التطور الإنساني ولكي تكون صالحة لكل مكان وزمان.
وفيه تصور قيام دولة دستورية إسلامية في العصر الحالي, دستورها وقوانينها مستمدة من الشريعة الإسلامية, والتأكيد فيه على الأسباب التي تستوجب مسائلة الرئيس ومحاسبته, وكيفية ذلك والجهة التي تقوم بذلك, حتى لا يجنح إلى الإستبداد والديكتاتورية لأنه حيثما توجد السلطة لا بد أن توجد المسؤولية المقابلة لها.
