للولي أهمية كبيرة في العقد، بل إن كل الخلل الذي حدث في نطاق العلاقات الإجتماعية الناتجة عن العلاقة بين الرجل والمرأة عن طريق عقد النكاح دون ولي كانت نتيجة لغياب هذا الولي، ومن هنا تبرز أهمية دور الولي في العقد، باعتباره أمراً لازماً، سواء جعلناه ركناً في العقد، أو شرطاً فيه، فعلى كل حال يلزم وجوده، وعلى أساس كل ما سبق رأيت أن أبحث الولاية في عقد النكاح، مبرزاً أركانها والآثار المترتبة عليها ووسائل إنهائها، ويقتضي بحث هذا الموضوع أن نقسمه إلى تمهيد وثلاثة فصول وخاتمة، أما التمهيد: فأذكر فيه تعريف الولاية في عقد النكاح عند الفقهاء أصحاب المذاهب الفقهية المختلفة كلما أمكن ذلك، وكذلك تعريفها عند الفقهاء المحدثين، ثم أخلص إلى تعريفها بناء على ما سبق من تعريفات، وأما الفصل الأول: فأتناول فيه أركان الولاية وشروط هذه الأركان، واما الفصل الثاني: فيكون في الآثار المترتبة على الولاية، وأما الفصل الثالث: فيكون في إنهاء الولاية وإنتقالها، وقد اتبعت في بحث هذا الموضوع منهج الدراسة المقارنة بين المذاهب الفقهية المختلفة ما أمكنني ذلك، مستدلاً لكل رأي، ذاكراً المناقشات التي أبديت حول أدلة الآراء، ثم أختار راياً من هذه الآراء اراه محققاً لمقاصد عقد النكاح، ولمقصد الولاية فيه على وجه الخصوص.
