تعد جرائم أسواق الأوراق المالية من الجرائم التي يتزايد حجمها يوماً تلو الآخر، رغم الجهود المحلية والدولية التي تبذل لمواجهتها، ذلك أن هذه الجرائم أضحت تشكل خطراً حقيقياً يؤدي الى زعزعة الثقة في المؤسسات المالية والتشجيع على ارتكاب المزيد من الجرائم، خاصة عندما يجنى مرتكبوها الأموال الطائلة.
لذلك تنصب هذه الدراسة بصفة أساسية على التشريع الإماراتي الخاص بحماية سوق الأوراق المالية، وبالتحديد القانون رقم 4 لسنة 2000. ولكن هذا القانون لن يتم تناوله من كافة جوانبه فهذا القانون يتناول موضوعات متعددة غير جنائية، فالتركيز هنا سوف ينصب على الشق الجنائي من هذا القانون.
وتسعى الدراسة الى التعرف على الحماية الجنائية الخاصة لسوق الأوراق المالية، وبيان أوجه النقص والقصور في نصوص القانون الاتحادي رقم (4) لسنة 2000م للوصول الى الحماية الجنائية المطلوبة.
من هذا المنطلق انتهج المؤلف في هذه الدراسة المنهج الوصفي، واستجلاء الملامح المختلف لمشكلة المدرسة. وجاءت الخطة من خلال بابين يسبقهما فصل تمهيدي. فصل تمهيدي: ماهية سوق الأوراق المالية، الباب الأول: الحماية الجنائية لشفافية سوق الأوراق المالية، الباب الثاني: الحماية الجنائية لآلية العمل بسوق الأوراق المالية.
