يهتم هذا البحث بدراسة الحماية الجزائية للمال العام، وذلك من خلال تناول الحماية الموضوعية التي نص عليها القانون الجنائي للمال العام، وهذه الحماية قد تضمنها القسم الخاص في قانون العقوبات، هي الحماية المترتبة على وجود النموذج التجريمي وتضمنه لشق الجزاء، وتعد الحماية الجزائية للمال العام الوسيلة الفعالة والناجحة في حماية هذا المال، لأنها تتضمن حماية عامة وفعالة وسريعة التطور، إذ تضع كل القواعد الكفيلة بحماية هذا المال مع سرعة تطويرها وتعديلها بما يتفق والظروف المستجدة.
والحماية الجزائية المقررة للمال العام أشد من تلك الحماية المقررة لأموال الأفراد الخاصة، فالمجني عليه في جرائم الإعتداء على المال العام هي الدولة أو أحد الأشخاص المعنوية العامة، لذلك شدد المشرع عقوبة هذه الجرائم وأخضعها لنصوص جزائية خاصة، ولم يخضعها للنماذج القانونية العامة، ولم يكتفِ بذلك بل جرم من جرائم الإعتداء العمدي وغير العمدي التي تقع على هذه الأموال سواء تطلّب تجريم الفعل توافر صفة خاصة بالجاني كما هو الحال في الجرائم التي تقع من الموظف أو المكلف بخدمة عامة، أو لم يتطلب ذلك كما هو الحال في الجرائم التي تقع من عامة الناس، وذلك من أجل فرض حماية متكاملة للمال العام.
