لئن كان قانون أصول المحاكمات الجزائية في جوهره هو قانون الكشف عن الحقيقة في أمر الجرم الواقع ومدى إمكان نسبته إلى المتهم، فإن حسن فهم هذا القانون نصوصاً وأحكاماً وفلسفة لا يتوقف عند مجرد الإلمام بحرفية نصوصه وما تزخر به من تفصيلات وشكليات، بل يتطلَّب مثل هذا الفهم العميق محاولة رد كل هذه النصوص والأحكام إلى "أصول قانونية".
وتقتضي دراسة مثل هذه الأصول القانونية الإجرائية إتباع منهج ما يتسم بتأصيل الحكم الإجرائي من ناحية وتقصي وتحليل عناصره من ناحية أخرى.
ومناهج دراسة قانون أصول المحاكمات الجزائية قد تتمايز من حيث الخطة المتبعة في دراسة أحكام هذا القانون، وإن اتفقت من حيث المضمون، والخطة التي اتبعها المؤلف تعتمد على دراسة أصول ثلاثة تشكِّل قوام الإجراءات الجزائية هي على التوالي: القاعدة الإجرائية، وماهية الدعوى العمومية وما قد يتبعها من دعوى مدنية ناشئة عن ذات المجرم، ثم سيرورة هذه الدعوى العمومية في مراحلها المختلفة.
فدراسة القاعدة الإجرائية تعني التعريف بقانون أصول المحاكمات الجزائية ذاته والتعرف على طبيعة القواعد التي يضمها، وتحديد نطاق تطبيقها، وإستخلاص الجزاء المترتب على مخالفتها، ودراسة ماهية الدعوى العمومية وما قد يتبعها من دعوى مدنية تتضمن الإحاطة بتعريف الدعوى العمومية ذاتها والتعرف على أطرافها الأصلية.
أما دراسة سيرورة الدعوى العمومية في مراحلها المختلفة فتقضي الإحاطة بالمراحل والإجراءات المختلفة التي تمر بها هذه الدعوى منذ لحظة وقوع الجريمة حتى صدور الحكم القضائي وقد جرت العادة على تمثيل هذه المراحل في ثلاث: الإستدلال والتحقيق والمحاكمة.
