يرمي هذا البحث إلى تحليل وتفكيك نسيج الخلافة الواردة على الأشياء المعنوية غير المادية ومُقارنتها مع الخلافة الناقلة للحقوق والإلتزامات الواردة على الأشياء المادية، وذلك لغرض الكشف عن طبيعة الوسائل المُؤثرة للإنتقال فيهما.
وقد وجدنا من خلال دراسة خلافة الحقوق والإلتزامات الشخصية في الأشياء غير المادية وتلمس مواقع الأهمية فيه من خلال الغور في مصادر التقنين المدني والتقنين التجاري ومُتابعة أحدث التشريعات التي تمكنا من الوصول إليها أن نُعالج هذا الموضوع ببحث مبسوط في فصل تمهيدي إقتضت وجوده مُتطلبات البحث العلمي وبابين نعقبهما بخاتمة، إذ خصصنا الفصل التمهيدي للتعريف بالأشياء غير المادية.
وقد كرسنا الباب الأول لِمعضلات إنتقال الملكية الفكرية وهي أساس الأشياء المعنوية وهي عديدة ومُتشابكة ودراستها لازمة قبل غور إنتقالها إلى الغير ولو إستلزم ذلك البحث في ماهيتها على قدر ما يتناسب مع موضوع بحثنا.
وأفردنا الباب الثاني لإنتقال ملكية الأشياء المعنوية غير المادية سواء بالإرث (على الرغم من كونهِ نتيجة ترتبت بسبب الوفاة) أو الوصية وهي في حقيقتها واقعة مُختلطة سببها الوفاة والتصرف القانوني أو بالتصرف القانوني الناقل للملكية كالبيع والتنازل عن الحق ونحوه.
ومن ثمَ أوصلنا البحث بخاتمة جامعة للأفكار والنتائج والعِبَر المُستخلصة منها، إذ إتبعنا في هذه الدراسة المنهج التحليلي الإستقرائي المُقَارن سبيلاً إلى غرضنا العلمي.
