تكاد نظرية الحق الشخصي (الإلتزام) أن تكون من أهم مواضيع القانون وأعقدها، فهي تقوم فيه مقام القطب من الرحى، فالقوة فيها تجعل دارس القانون أو المشتغل فيه قوياً في حجته، قادراً على فهم غيرها من مواضيع القانون المتشعبة، ولكي نساهم في تحقيق هذا الهدف أنجزنا بعون الله تعالى وتوفيقه هذا المؤلف الذي نعتقد ونأمل أن يكون قد استجاب لأمرين هامين قصدناهما فيه، أولهما: تركيز الدراسة الأساسية على القانون المدني الأردني، دون إهمال الإشارة، حيث تجب، إلى الفقه الإسلامي الذي هو أصل هذا القانون والإطار الذي يدور فيه، وإلى ما عليه الموقف في القوانين الأخرى خصوصاً القانون الفرنسي، مع أحدث تطبيقاته القضائية، رغبة منا في بيان مدى أهمية الدراسة المقارنة في إثراء القانون النافذ.
إلا أن هذه المقارنة ظلت في حدودها المفيدة دون إسهاب، وهذا ما يحقق الفائدة للأستاذ والطالب، حيث يجنبهما الخوض في مواضيع تصرف جهدهما عن صلب الدراسة، ودون أن ننسى الباحث الذي يجد دراسة جديدة غير تقليدية تصلح مرجعاً قانونياً يعتمد عليه في كتابة الأبحاث والرسائل الجامعية.
أما الأمر الثاني: فقد تجنبنا في هذا الكتاب الإختصار الشديد الذي وقعت فيه بعض المؤلفات، والذي يشكل عائقاً أمام دارس القانون في فهم النظرية العامة للحقوق الشخصية، التي هي من أعقد المواضيع وأصعبها، والتي لا بد من توضيح أحكامها بشرح وافٍ تؤيده الأمثلة والأحكام القضائية، لذلك أشرنا في دراستنا إلى الكثير من القرارات الحديثة لمحكمتي التمييز الأردنية والفرنسية.
وفي الختام، لا نخفي ما لاقيناه من صعوبة في إعداد هذا الكتاب، وقد زاد في هذه الصعوبة ندرة المؤلفات في هذا المجال في القانون الأردني، وتشعب المصادر التي اقتبس منها المشرع الأردني نصوص قانونه المدني والتي تتردد بين مجلة الأحكام العدلية وقواعد الفقة الإسلامي بمذاهبه المختلفة والقوانين الوضعية.
نأمل أن نكون - في هذا المؤلف - قد وضعنا لبنة في علم القانون في هذا البلد العزيز، ونسأل الله تعالى أن ينفعنا وأن ينفع بنا إنه نعم المولى ونعم المصير.
