يطرح البحث في الموضوع المتناول تساؤلات عديدة، بعضها له علاقة بالواقع الذي نعيش في الدول النامية عموماً؛ بشأن طبيعة التحول في سياسات التنمية الإقتصادية في بعض الدول النامية، من إتباع سياسات إشتراكية، إلى إتباع سياسات ليبرالية أكثر إنفتاحاً على العالم، وكيف أثر هذا التحول على تغير وجهة نظر حكومات بعض الدول النامية نحو التحكيم، كعنصر من عناصر التحول الأكبر في هذه الدول، وهل كان تحول حكومات هذه الدول نحو التحكيم موحداً، أم بنسب متفاوتة، وكيف يمكن الإستدلال على هذا التحول، عند دراسة قوانين التحكيم الخاصة بها، وما مدى تأثير نظام العولمة السائد حالياً في هذا الصدد.
وثمة تساؤلات اخرى تطرح نفسها لها علاقة بالواقع الفلسطيني، وتتعلق بأثر هذا التحول على منظومة التشريعات الإقتصادية في فلسطين، وما هو موقف قانون التحكيم الفلسطيني من التحكيم التجاري الدولي، وما هي أوجه التشابه والإختلاف بين النصوص المؤيدة للتحكيم التجاري الدولي الواردة في قانون التحكيم الفلسطيني، وتلك الواردة في قوانين التحكيم في بعض الدول النامية.
وهل يرقى موقف قانون التحكيم الفلسطيني من التحكيم التجاري الدولي إلى موقف قوانين التحكيم المطبقة في الدول الليبرالية المتقدمة، وهل راعى قانون التحكيم الفلسطيني في أحكامه المؤيدة للتحكيم التجاري الدولي، الأحكام المنصوص عليها في القوانين والقواعد، والإتفاقات الدولية، ذات العلاقة بالتحكيم التجاري الدولي.
