Book Description
التحكيم في اللغة هو تفويض الحكم لشخص. يقال: حكمت الرجل أي فوضت إليه الحكم، ويقال لذلك حكم ومحكم وهي لفظة من باب التفعيل. والمحكم من باب التفعيل بصيغة اسم الفاعل فهي اللفظة التي تدل على أحد الخصوم و"المحكمين" أي الخصوم أو طرفي النزاع، والتحكيم قانوناً: هو نظام لتسوية المنازعات عن طريق أفراد عاديين يختارهم الخصوم إما مباشرة أو عن طريق وسيلة أخرى يرتضونها. أو هو مكنة أطراف النزاع بإقصاء منازعتهم عن الخضوع لقضاء المحاكم المخول لها طبق القانون، كيما تحل عن طريق أشخاص يختارونهم.
في إطار هذا التعريف تأتي الدراسة التي بين يدينا والتي هي عبارة عن بحث في قانون التجارة الدولية، اهتم بتسليط الضوء على موضوع التحكيم التجاري الدولي وذلك في تمهيد وخمسة فصول وخاتمة، التمهيد نبذة سريعة عن التحكيم، تعريفه، فرقه، عما يمكن أن يشتبه به من مؤسسات قانونية أخرى.
وبحث الفصل الأول في الاتفاقية لجهة ظروف عقدها، والملاحظات التي عليها وقيمتها القانونية لجهة تاريخ نفاذها والدول التي انضمت إليها. أما الفصل الثاني فبحث بالهيئات التي نصت عليها الاتفاقية العربية للتحكيم، وتحدث في الفصل الثالث عن عقد التحكيم تكوينه وشروطه. كما وتحدث في الفصل الرابع عن إجراءات التحكيم وفقاً للاتفاقية العربية للتحكيم.
أما الفصل الخامس والأخير فخصص لتناول القرار التحكيمي ونتائجه، حيث تم التركيز في هذا الفصل على مقارنة نصوص الاتفاقيات الدولية والإقليمية حول طلب إبطال القرار التحكيمي ورفض تنفيذه وذلك لما لهذا الموضوع من أهمية خاصة. وختم البحث بخاتمة تم التحدث فيها عن تقييم الاتفاقية والملاحظات لتي يحلها، وسيكون المنهج في بحث هذه الاتفاقية مقارناً بالاتفاقيات العالمية والإقليمية والعربية التي تناولت موضوع التحكيم، إضافة إلى أنه تطرق قدر الإمكان إلى ما يوافقها وما يخالفها من أنظمة التحكيم التي تعمل بها غرف التجارة الدولية والإقليمية.
