نتيجة لإتساع رقعة التجارة الدولية تطوّر نشاط التجار أفراداً وشركات، وظهرت شركات كبيرة كالشركات متعددة الجنسيات وتوزعت الأموال والأصول في أكثر من دولة؛ فلم تعد مشكلة الإفلاس محلية إنما اتسع نطاقها إلى خارج حدود الدولة الواحدة، مما أدى إلى ظهور مشكلة الإفلاس عبر الحدود، ويثير هذا النوع من الإفلاس مشاكل قانونية عديدة في ظل غياب التنظيم القانوني له، لا سيما في التشريعات الوطنية للعديد من الدول، فقواعد الإفلاس في القانون الأردني لم تتضمن أحكاماً لمعالجة هذا النوع من القضايا، مما يؤثر سلباً على حقوق الدائنين سواء أكانوا موجودين في الأردن أم خارجه وسواء أكانوا أردنيين أم من جنسيات أخرى.
وتهدف هذه الدراسة إلى محاولة إيجاد الحلول القانونية لسد النقص في قواعد الإفلاس في قانون التجارة الأردني سواء من خلال تعديلها أو من خلال سن قانون مستقل للإفلاس عبر الحدود؛ وذلك لتحقيق إدارة فاعلة للقضايا المتعلقة به لتوفير حماية قانونية للدائنين.
