يتناول هذا الكتاب دراسة الحماية القانونية للطفل في القانون الدولي والوطني والفقه الإسلامي من حيث المصدر والتطبيق فالأساس الدولي لحقوق الطفل يكمن في إعلان جنيف لحقوق الطفل لسنة 1989، والاتفاقية العالمية لحقوق الطفل الصادرة في عام 1989 من الأمم المتحدة UN، والتي تعد المظلة الدولية التي تحمي حقوق الأطفال في العالم، وهي أول معاهدة تعني بشكل مباشر بحماية حقوق الأطفال، وقد أحدثت نقلة نوعية نحو الحماية الحقوقية للطفل.
وفي المجال الوطني تلتزم السلطات التشريعية والتنفيذية باحترام نصوص دستور 2014 عن حقوق الطفل، وكذا نصوص قانون حقوق الطفل رقم 12 لسنة 1996، المعدل بالقانون رقم 126 لسنة 2008 والتشريعات الأخرى المقررة لحماية الطفل.
وتقوم السلطات القضائية بدور هام في كفالة حقوق الطفل كما وردت في الدستور والتشريعات الوطنية. وكما وردت في المعاهدات الدولية التي أصبحت تشريعات وطنية عقب التصديق عليها ونشرها في الجريدة الرسمية لتصبح ملزمة للكافة.
وحماية حقوق الطفل في الشريعة الإسلامية مقررة من رب العباد وهو الخالق العليم بما يصلح للنفس البشرية التي خلقها وسواها، ولهذا جاءت أحكام الشريعة متخطية لحدود الزمان والمكان والمحاولة والخطأ، عادلة عدالة مطلقة، ففصلت مجال حماية واقعية للطفل، وهذه الحماية لحقوق الطفل تقتضي العناية بتدريسه على نطاق واسع وبث الثقافة بقواعد حماية الطفل، لدى أكبر قاعدة من الناس ليتحقق أكبر فائدة من معرفة الحماية القانونية للطفل.
