إذا كانت نظرية الالتزام تعرف الإنهاء الانفرادي للعقد، فهل يمكن أن تعترف بالتعديل الانفرادي للعقد؟ فهل يمكن لأحد المتعاقدين أو لكليهما أن يعدل العقد بإرادته المنفردة؟ هذا هو محل البحث الذي بين أيدينا، فهو يتعلق بمدى إمكانية الاعتراف في قانون العقود لأحد المتعاقدين أو لكليهما بالحق في تعديل العقد بالإرادة المنفردة.
ويثير موضوع الدراسة عن التعديل الانفرادي للعقد العديد من التساؤلات: عن مفهوم التعديل بصفة عامة وهل يعد مفهوماً قانونياً أم مجرد مصطلح لغوي لا يعني سوى التغيير في أحد شروط العقد؟ وإذا كان التعديل مفهوماً قانونياً، مثله مثل الإنشاء والإنهاء، فهل يمكن الاعتراف بوجود تعديل للعقد بالإرادة المنفردة؟ وما هى العقبات التي تقف أمام مثل هذا الاعتراف؟ وهل يمكن التغلب عليها؟ وأخيراً ما هى الفائدة من إقرار مثل هذا الأمر في النظم القانونية؟
وربما يتصل بالفائدة من إقرار التعديل بالإرادة المنفردة للعقد ما يجري في العمل، فيما يتعلق بعقود السفر والسياحة، من تغيير في مواعيد الإقلاع والسفر، ويمكن أن يصل هذا الأمر إلى إلغاء الرحلة أو تأجيلها، كما أن الأمر لا يقتصر على التغيير في مواعيد السفر، بل قد يشمل أيضاً التعديل في برنامج الرحلة. فإذا كان الوضع كذلك، فيكون من المفيد أن نفرد، بعد مناقشة مدي الاعتراف بفكرة التعديل بالإرادة المنفردة للعقد في نظرية الالتزام، دراسة خاصة لعقود السياحة والسفر كتطبيق من أهم تطبيقات تعديل العقد بالإرادة المنفردة.
