الفرض الذي نعرض له يتمثل عملاً في رفع دعوى التعويض المدنية من سائح ما أو عميل أصيب بضرر "جسدي او مالي" أثناء رحلة فردية، أو شاملة نظمتها وكالة للسياحة، والسفر. وفيها تثور تساؤلات عدة عن مدى التزامات الوكالة المدعي عليها أو نطاقها، وهل تختلف هذه الالتزامات في الرحلات غير المنظمة عنها في الرحلات الشاملة؟ وما أساس هذه الاختلافات إن وجدت؟ وهل يمكن مساءلة الوكالة المذكورة عن عمل الغير الذين عهدت إليهم تنفيذ بعض التزامات الرحلة، كالنقل مثلاً، او المرشد السياحي،.....أو غيرهما؟ وما أساس هذه المسئولية في عقد الرحلة؟
ولا يمكن للباحث أن يتجاهل اجابة عن هذه التساؤلات، سواء بالنظر إلى اتساع الأنشطة السياحية التي تقوم بها وكالات السياحة والسفر أو إلى طبيعة النشاط الذي تمارسه هذه الوكالات، وتثير في فقه القانون المدني مشكلات عدة. ولا يمكن في الوقت نفسه الإجابة عن هذه التساؤلات المتعلقة بالتزامات وكالة السياحة، والسفر ومسؤوليتها، دون بيان طبيعة الرابطة بينها، وبين العملاء، وانعكس ذلك بدوره على التزاماتها، ومسئوليتها المدنية. ناهيك بأن الموضوع برمته لم يحظ بأية دراسات في فقة القانون المدني في مصر.
وفي مناخ، يتميز بنقص الدراسات، وتطور الأنشطة السياحية، وتعقد النصوص، وتشابك العلاقات الناشئة عن الرحلة نخوض غمار البحث، أملاً في سد النقص الكائن، ورغبة في التوصل إلى نتائج محددة، أو وضع لبنة تصلح للبناء عليها.
