لقد أثارت مسألة الأخذ بالنظام الفيدرالي والدور المرسوم للرئيس في هذا الاتحاد، خلافًا فقهيًا طويلًا بين مؤيد ومعارض، فقد نجح هذا النظام في بعض الدول نجاحًا منقطع النظير، وكان سببًا لقوتها وربما تسيدها على العالم، كما في الولايات المتحدة الأمريكية والاتحاد السوفيتي السابق.
ومع نجاح هذا النظام في بعض الدول فشل في دول أخرى، وكان سببًا في مأساة ومعانات شعوب هذه الدول، كما في يوغسلافيا السابقة. وعلى حد سواء مع الاتحادات الأخرى، وقفت وراء تبني النظام الفيدرالي عدة أسباب، فهذا الاتحاد وسيلة لتقوية الروابط التي توجدها الاتحادات الأخرى، فمن خلال هذا الاتحاد يتم دمج شعوب الدويلات الداخلة في الاتحاد، متجاوزًا عقبات الاختلاف والتباين اللغوي والديني والعرقي. وقد يكون الاتحاد الفيدرالي وسيلة لإدارة الدولة ذات الرقعة الجغرافية الواسعة فقد لا تتمكن السلطة المركزية في الدولة الموحدة من إدارة شؤونها على أكمل وجه فتتخذ من الإدارة المزدوجة وسيلة لضمان وحدة الدولة من ناحية وهيمنة السلطة المركزية من ناحية أخرى، من خلال إيجاد سلطة تدير الشؤون المحلية تحت هيمنتها وإشرافها ولنا في روسيا خير مثال على ذلك، فالسهل الروسي لا يمتد إلى جبال الأوراس فحسب، بل إلى وسط أسيا وسيبيريا أيضًا.
