بقدر ما يمثله حق الحياة للإنسان من تقدير وتكريم، فإن حقه في ممارسة الحرية يأتي تجسيداً لتمتعه بهذا الحق الذي هو نعمة الحياة، فالإنسان المستعبد لا يذوق أبداً طعم الحياة، والإنسان المحروم من حريته غير قادر على ممارسة إنسانيته، ومن ثم يفقد الإنسان أهليته بقدر ما يفقد إرادته.
ونعني بالحرية هنا الحرية المتساوقة مع كرامته الإنسانية والمنضبطة بحدود لا تمس حرية الآخرين ولا تؤذي مشاعر المجتمع، ومن أروع ما قيل في الحرية أنها فضاء إنساني يحلق فيه الإنسان بإرادته دون خوف من رقيب سوى ما يمليه عليه النظام العام والآداب من ضوابط.
إن أهمية إحترام وحماية الحرية الشخصية تنبع من كونها تعد أصل الحريات الأساسية لتعلقها بذات الإنسان، فبدونها لا يستطيع الفرد أن يمارس أية حرية من حرياته، وأن ضرورة حمايتها لازمة لحفظ حياة الإنسان وكرامته وأمنه وأسراره وتنقلاته وسلامة جسده، لا تمنحها السلطة بل تنظم ممارستها بقوانين، ولا شيء يحد منها إلا إذا تعارضت مع المصلحة العامة.
