في هذا العمل يقدم الباحث "مختار الأسدي" مقارنة نقدية تتناول الحريات وحقوق الإنسان من زوايا مختلفة.
ما يميز طرح "الأسدي" عن غيره ممن تناول الحريات وحقوق الإنسان من الباحثين هو أنه يحاول أن يصور لنا جمالية الحق وعظم منزلة الإنسان وعمق الأخوة الإنسانية، متنقلاُ بين مثالية الأحكام والنظريات، ودعاوى الأدعياء والمنظرين، معبَراً عن لوعة وألمٍ دفين لواقع البون الشاسع بين هذه المثالية أو هذه الدعاوى، وبين الممارسات اليومية للحكام والحكومات.
وما بين دفتي الكتاب يستعرض الكاتب أهم الموائيق ففي ثقافة الحقوق والحريات والمتمثلة في الإعلان العالمي لحقوق الإنسان من جهة، وما أوصت به الشريعة الإسلامية من جهة أخرى، وذلك عبر استعراض سريع لرسالة الحقوق للإمام زين العابدين عليه السلام، مروراً بالبيان الختامي للمؤتمر الخامس للفكر الإسلامي، ثم دستور الجمهورية الإسلامية في إيران وبعض الإثارات حوله وفيه، وأخيراً مشروع الإعلان الإسلامي لحقوق الإنسان. ومن خلال هذا العرض يقدم لنا الكاتب عرضاً مجملاً لما تمخضت عنه تجربة صدر الإسلام الأولى، وضمن محاولة جادة أخرى يوضح الكاتب دور الأمة في تقرير مصيرها، وأخرى يستنطق فيها الآيتين القرآنيتين الكريمتين (وشاورهم في الأمر)، (وأمرهم شورى بينهم) وتطبيقاتهم في سلوك النبي محمد صلى الله عليه وسلم ومواقف الأئمة والتابعين من بعده، وكيف يمكن تفسيرها كواجب أخلاقي ومبدئي على الحاكم، ووظيفة شرعية وسلوك رسالة على المحكوم. كذلك يستعرض الكاتب حق الأمة في الرقابة، وحقها في تعيين الحاكم أو عزله، إضافة إلى إثارات جادة حول حرية الضمير وحرية الرأي وحرية التعبير، وحق المساواة، وحق الهجرة واللجوء، وحق المعتقد، وما يرافق ذلك من حقوق للآخرين على الفرد نفسه، كحق الصديق وحق الجار وحق الخصم وحقوق الأبناء وحقوق الوالدين وحقوق المرأة والطفل، وأهمها جميعاً برأي الكاتب حق (الرعية) على (الراعي) وحق الراعي على الرعية –كما يقولون.
