تصدرت الحقوق والحريات العامة مطاليب الثورات التي أقيمت في مختلف بلدان العالم إن لم تكن مطلبها الوحيد.
جاءت أهمية هذا الكتاب في خضم الصراع الذي تشهده المنطقة العربية في السعي نحو الديمقراطية، بعد إن عانت تلك البلدان من سيطرة الثلة الحاكمة التي هيمنت على مقدرات البلد، وانتهكت الحقوق والحريات للحفاظ على سلطانها، وجمعت بين السلطتين التشريعية والتنفيذية حيث كانت الأولى مجرد غرفة تسجيل لدى الثانية.
وعلى الرغم من تلك الأهمية فإن غالبية الدراسات والأبحاث في مجال تقييد الحقوق والحريات العامة تناولت تقييدها من جانب السلطة التنفيذية، ولم تتعرض إلى تقييدها من قبل السلطة التشريعية إلا لماماً.
إلا إن البحث في هذا المجال يوجب بيان إشكالية العلاقة بين القانون والحرية، فالقانون ينطوي بالضرورة على الإلتزام بأحكامه حتى لو تطلب ذلك الإكراه، في حين ان الحرية القدرة على القيام بالفعل من دون إكراه، إلا إن الأمر ليس بهذه الدرجة من الإختلاف بينهما، فهناك الكثير من المشتركات.
وهذا يستتبع البحث عن المعايير الدستورية والدولية التي يمكن الإستعانة بها لضبط العملية التشريعية في التقييد، ومدى إستجابة التشريعات المقيدة للحقوق والحريات في الدول المقارنة لتلك المعايير.
