يعتبر الإحتلال والإستعمار أفظع صور إنتهاك حقوق الإنسان وحرياته، حيث يجري فرض إرادة دولة أجنبية على إرادة شعب وإنتهاك سيادة دولته.
وفي المراحل الأولى من التوغل الأوروبي في العالم الإسلامي قاوم المسلمون في مواقع كثيرة الوضع الجديد بالقوة، وكانت عقيدة الجهاد هي الطريقة الوحيدة المتاحة بأيديهم، والقادرة على تعبئة الجماهير ضد الغزو الإستعماري، إلا ان المجتمعات الإسلامية آنذاك كانت تفتقد التنظيم ما عدا المؤسسات الدينية، التي كان بوسعها تعبئة المسلمين في حركة منظمة ضد القوى الإستعمارية.
وفي العراق كانت وما زالت المرجعية الشيعية تمثل معلماً كبيراً من معالم الحياة السياسية والثورية، إذ لعبت دوراً أساسياً في حركة الجهاد التي انطلقت لمواجهة الإحتلال البريطاني، وبقيت تمثل محور الحركة في الثورات والإنتفاضات.
يلقي هذا الكتاب الضوء على تأثير الفتوى على المجتمع المسلم، فأختار المؤلف فتاوى السيد "كاظم اليزدي" على تاريخ العراق السياسي بعد الإحتلال البريطاني عام 1914، واعتمد منهج الغوص في الأحداث وتحليل مدلولاتها وتأثيراتها السياسية والفكرية والإجتماعية.
فوزع الكتاب على تسعة فصول تناول فيها: المؤسسة الدينية الشيعية ودور العتبات المقدسة في نشوء المدن المقدسة، وأوضاع الشيعة في العراق خلال فترة الإحتلال العثماني، وعقيدة الجهاد عند الفقهاء الشيعة، والفرق بين الفتوى والحكم، ومواقف العلماء المسلمين المعاصرين للسيد "اليزدي"، وموقف اليهود والمسيحيين العراقيين من الإحتلال البريطاني، ووقائع حركة الجهاد ضد الإحتلال البريطاني.
