رغم وجود إتجاه يقرر مساواة أحكام التحكيم الأجنبية بأحكام التحكيم الداخلية أو الوطنية، وذلك تبعاً لطبيعة التحكيم الخاصة والتي مؤداها أن حكم التحكيم ذو سمة مختلطة مركبة لا تسمح من جهة بمعاملته باعتباره حكماً قضائياً، ولا تسمح من جهة أخرى باعتباره عقداً من العقود، ولذا فكلاهما لا يتمتع بالقوة التنفيذية إلا بإتخاذ إجراء لدى السلطة العامة المختصة في الدولة التي سيجري فيها التنفيذ، وهذا ما أكده القضاء الفرنسي حيث قرر بأن حكم التحكيم الأجنبي يجب أن يخضع في فرنسا لنفس القواعد المقررة لأحكام التحكيم الفرنسية. لكن هذا يكون مخالفاً لما يجرى عليه العمل في أنظمة أخرى ترتب علي إختلاف وصف الحكم من أجنبي إلي داخلي إختلاف القواعد الواجبة التطبيق، كما هو الحال في قانون التحكيم المصري رقم 27 لسنة 1994 حيث يميز بينهما من حيث المحكمة المختصة وسلطتها... ألخ علي الوجه الذي سنعرض له في حينه. بل إن قانون المرافعات المصري ينص صراحة علي معاملة أحكام التحكيم الأجنبية معاملة الأحكام اجنبية (م 229 مرافعات)، وأياً كانت المعايير المتخذة أساساً للتمييز بين ما إذا كان حكم التحكيم داخلياً أم أجنبيا وهو ما يعبر عنه غالباً بالتحكيم التجاري الدولي فإنه يترتب علي هذا التمييز نتائج في غاية الأهمية.
وهكذا فالعرض السابق يفرض علينا فرضاً ضرورة التمييز بين الإجراءات اللازم إتخاذها لتنفيذ أحكام التحكيم الداخلية أو الوطنية وتلك التي يلزم اتباعها لتنفيذ الأحكام الأجنبية أو التي يكون موضوعها تجارياً دولياً. لذا فإن الباب سيكرس بمشيئة الله تعالي لبيان النظام القانوني لتنفيذ أحكام التحكيم الأجنبية أو المتعلقة بالتجارة الدولية.
