إذا كانت الحلول السلمية كثيرة ومتعددة فإننا سوف نقصر دراستنا على التوفيق كوسيلة ودية لفض المنازعات لأنها الأكثر استخداماً وشيوعاً في الدول العربية بصفة عامة وفي جمهورية مصر العربية بصفة خاصة، وهذا يتطلب منا أن نعرض لتعريفها والتمييز بينها وبين غيرها من الوسائل الرضائية الأخرى.
دراسة الأحكام الخاصة بالتوفيق كوسيلة ودية سلمية رضائية لفض المنازعات وبعض تطبيقاتها العملية تتطلب منا التعرض للنقاط التالية: تطور محاولات التوفيق بين الخصوم، الجهة المختصة بإجراء محاولة التوفيق، الشروط اللازم توافرها لإجراء هذه المحاولة، ميعاد وإجراءات محاولة التوفيق بين الخصوم، مدى إمكانية الاعتراض على القرارا الصادر عن محاولة التوفيق، واخيراً للقوة التنفيذية لمحضر التوفيق، علماً بأن هذه الدراسة سوف لا تقتصر على النظام المصري، بل ستعرض وبقدر الإمكان لبعض الأنظمة القانونية الأخرى خاصة تلك التي قطعت شوطاً كبيراً في استخدام الوسائل الرضائية أو البديلة للعدالة القضائية بغية الوقوف على احكامها والاستفادة منها.
وعلى ذلك تتكون خطة البحث لهذه الدراسة من ستة فصول هي كالتالي:-
الفصل الأول: تطور محاولات التوفيق بين الخصوم، الفصل الثاني: الجهة المختصة بإجراء محاولة التوفيق، الفصل الثالث: الشروط اللازم توافرها لإجراء محاولة التوفيق، الفصل الرابع: ميعاد وإجراءات محاولة التوفيق بين الخصوم، الفصل الخامس: مدى امكانية الاعتراض على القرار الصادر عن محاولة التوفيق، الفصل السادس: القوة التنفيذية لمحضر التوفيق.
