تتلخص أهمية البحث في النظام القانوني لاتفاق التحكيم بسبب مكانته في مسيرة التحكيم، وللخصوصيات التي ينفرد بها من حيث انعقاده وآثاره التي يرتبها، وأن هذا الموضوع علي الرغم مما له من أهمية لم يحظ بالدراسة الوافية من زاوية القانون المدني.
وسيتم اتباع المنهج التحليلي المقارن للنصوص القانونية المنظمة للاتفاق في القانون اليمني سواء وجد النص في قانون التحكيم الذي يعد القانون الخاص أو العودة إلي القانون المدني الذي يعد الشريعة العامة والمرجع المنظم لأحكام العقد، مقارنة ذلك بنظام التحيكم السعودي وقانون التحكيم المصري، وأيضاً سيتم العرض لقانون التحكيم الأردني باعتباره الأحدث صدوراً عند إعداد هذه الدراسة، ولا يمنع ذلك من الإشارة إلي بعض اتفاق التحكيم من زاوية القانون المدني، ويخرج عن نطاق هذه الدراسة التحكيم في مجال القانون الدولي العام أي التحكيم في المنازعات التي تنشأ بين الدول وكذا التحكيم الإجباري كونه يتم بدون اتفاق.
كما يستبعد من هذه الدراسة مشكلات تنازع القوانين والقانون الواجب التطبيق، والتي يهتم بها القانون الدولي الخاص، ويستبعد أيضاً من الدراسة تناول الجانب الإجرائي لخصومة التحكيم والتي يهتم بها قانون المرافعات.
وقد وجدنا أنه من المناسب لتناول هذا الموضوع أن يقسم إلي "مقدمة وتتضمن موضوع البحث وأهميته، وأسباب اختياره والمنهج المتبع، وتساؤلات البحث وصعوباته، الفصل التمهيدي سيتم البحث فيه عن مفهوم التحكيم، الفصل الأول سيتم البحث فيه عن مفهوم اتفاق التحكيم، الفصل الثاني انعقاد اتفاق التحكيم، الفصل الثالث تفسير اتفاق التحكيم وآثاره وانقضائه، الخاتمة ويبين فيها الباحث أهم الاستنتاجات والتوصيات التي توصل إليها".
