إن الإعتقال هو الإبن الشرعي لقانون الطوارئ، فمتى أعلنت حالة الطوارئ جاز إعتقال أي شخص، أي شخص متى كان خطراص على الأمن والنظام العام، وغاية أمر الإعتقال حماية النظام السياسي والإجتماعي والإقتصادي للدولة، والتسليم بمشروعية هذه الغاية تعني أن قرار الإعتقال يوجه لفئتين أو طائفتين، الأولى الخطرين سياسياً، والثانية الخطرين جنائياً، ولا يعني اعتقال الخطرين سياسياً اعتقال المعارضين- كل المعارضين لنظام الحكم- فالمعتقلات لا تتسع لهذا العدد الضخم، وإنما يعني إعتقال الخطرين سياسياً إعتقال من تسول له نفسه العبث بالنظام السياسي للدولة دون أن يكون التغيير وفق الأسس القانونية والدستورية، وعلى هذا سوف تكون خطة البحث كالتالي: (الفصل الأول: قرار الإعتقال السياسي والجنائي، الفصل الثاني: التظلم من قرار الإعتقال السياسي، الفصل الثالث: التعويض عن الإعتقال الباطل والتعسفي والتعذيب).
