إن علماء الفقه الإسلامي وكذلك شراح القانون الوضعي قد اختلفوا في مسألة ما للإنسان من حق على جسمه ومدى قدرته على التصرف في هذا الحق.
وقد شدني للكتابة في هذا الموضوع أن كل مسائله تقريباً محل خلاف بين الفقهاء سواء في الفقه الإسلامي أو القانون الوضعي، فاختلفوا في مدى ما للإنسان من قدرة على التصرف في أعضائه، واختلفوا في طبيعة جسم الإنسان، هل يعتبر مالاً أم لا، واختلفوا في طبيعة أو تكييف حق الإنسان على جسمه، هل هو حق ملكية أم حق انتفاع وإذا كان حقه على جسمه حق انتفاع فعلي أي أساس تنتقل ملكية العضو ذاته للمستفيد.. الخ، ولما وجدنا أن مسألة مدى ما للإنسان من سلطو أو قدرة على التصرف في أعضائه قد أدلى الكثير من العلماء وشراح القانون بدلوهم فيها، اخترت المسألة الخاصة بمحل التصرفات التي ترد على الأعضاء البشرية الجامدة موضوعاً لهذا البحث.
وقد اقتضت طبيعة هذا البحث وما يشمل عليه من مسائل أن أقسمه إلى تمهيد وفصلين وخاتمة، التمهيد في: المقصود بالأعضاء البشرية وعلاقة القانون المدني بها، الفصل الأول: التصرفات التي يمكن أن ترد على الأعضاء البشرية الجامدة، الفصل الثاني: محل التصرفات التي ترد على الأعضاء البشرية الجامدة، الخاتمة: وتتضمن أهم نتائج البحث.
