تحتل الدراسات المتعلقة بالقانون المدني أهمية خاصة لصلتها المباشرة بالمعاملات اليومية للأفراد وللتأمينات العينية أو الشخصية أهميتها الواضحة في إطار هذا القانون لأنها توفر الضمان والحماية التي يحتاجها أصحاب الحقوق لضمان حصولهم على حقوقهم.
إن أهم ما يميز تلك التأمينات بنوعيها، العينية من رهن تأميني وحيازي وحق إمتياز أو الشخصية (الكفالة)، صفة التبعية للإلتزام الأصلي المضمون، فهي لا تنشأ بصورة مستقلة وإنما تكون تابعة في نشوئها للإلتزام المضمون والهدف من نشؤها ضمان الوفاء به.
لذا فإن صفة التبعية تلك بين التأمينات والإلتزام الأصلي المضمون تحكم التأمينات في مختلف مراحلها منذ النشوء ولحين الإنقضاء، فبداية لا يمكن ان تنشأ التأمينات وتكون صحيحة إلا إذا كان هناك إلتزام أصلي مستكمل لشروط الوجود والصحة.
وإن كان الإلتزام باطلاً تبعته التأمينات في بطلانها، ثم إن نطاق التأمينات يتحدد بحدود الإلتزام الأصلي وتوابعه حيث تضمن التأمينات الوفاء بالإلتزام الأصلي وكذلك توابعه كالفائدة مثلاً، وتمتد التبعية لتلحق التأمينات في أوصاف الإلتزام التبعي، حيث إن الإلتزام التبعي للراهن أو الكفيل يحمل الصفة ذاتها التي يتصف بها الإلتزام الأصلي كما لو كان الإلتزام الأصلي موصوفاً بشرط أو أجل أو غيرها.
وتستمر تلك الهيمنة لصفة التبعية على التأمينات عند إنتقال الإلتزام الأصلي المضمون في تنتقل أيضاً، كأصل عام، بإنتقاله بطرق الإنتقال المختلفة، وأخيراً تمتد تلك الصفة لتشمل الإنقضاء والزوال للتأمينات والتي تنقضي وتزول بصفة تبعية تبعاً لإنقضاء أو زوال الإلتزام الأصلي المضمون.
إن هذه الدراسة التي تركز على صفة التبعية والتي تتصف بها التأمينات هي دراسة مقارنة بين القوانين المدنية والفقه الإسلامي لما يتمتع به هذا الفقه من غنى يثري الدراسة بحلوله وآراء فقهانه المتعددة والمتنوعة بما يفتح مجالاً أوسع للنقاش العلمي المثمر.
