المحاكمة هي المرحلة الثانية للدعوى الجنائية، ويطلق عليها كذلك تعبير "التحقيق النهائي" وهي مجموعة من الإجراءات تستهدف تمحيص أدلة الدعوى جميعاً، ما كان منها ضد مصلحة المتهم وما كان في مصلحته، وتهدف بذلك إلى تقصي كل الحقيقة الواقعية والقانونية في شأنها، ثم الفصل في موضوعها إما بالإدانة إن كانت الأدلة جازمة بذلك، وإما بالبراءة إن لم تتوافر الأدلة الجازمة بالإدانة.
وتتضمن دراسة المحاكمة البحث في مبادئها العامة، ثم تفصيل إجراءاتها ثم الحكم الجنائي، وأسباب بطلانه، وتختتم بالمصلحة في الطعن بالبطلان في الإجراءات أو في الحكم.
