يبحث موضوع هذا المؤلف في أصول المحاكمة الجنائية.. ويقصد بذلك كل ما ورد بنصوص الدستور والقانون من مبادئ وضمانات تكفل للمتهم حماية حقيقية حال مثوله أمام المحكمة الجنائية، بحسبان أن القانون بمعناه الواسع- ينصرف مدلوله ويتسع ليشمل الحماية الدستورية والتشريعية على حد سواء.
من هذا المنطلق عكفنا على هذه الدراسة بما تتطلبه من إلمام بأوجه الحماية التي كفلها الدستور للمتهم خلال مرحلة المحاكمة، وكل ذلك في حدود المصلحة العامة، إذ لا بد من حدوث توازن بين هذه الحماية للحقوق والحريات من ناحية وبين اعتبارات المصلحة العامة من ناحية أخرى.
وقد عنينا ببحث تطبيقات هذه الحماية في قانون العقوبات في باب أول ثم أفردنا بابًا ثانيًا لهذه الحماية في قانون الإجراءات الجنائية. وعلى هدي ما تقدم تظهر لنا حتمية إفراد فصل تمهيدي لبحث مضمون الحماية الدستورية للمتهم في مرحلة المحاكمة الجنائية، ثم نورد بابين آخرين لبيان هذه الحماية في قانون العقوبات وقانون الإجراءات الجنائية كل في باب مستقل.
