Book Description
إن المسؤولية في جوانبها الشخصية، والمبدئية، الجزائية، والسياسية والاجتماعية، هي كلٌّ في واحد لا يتجزأ ولا ينجزئ. من هذا المنطلق الفلسفي يدعو هذا الكتاب، إلى رعاية هذا المبدأ، وبالتالي فإن الأخذ بالظروف، تعليلاً وتأويلاً ومحاكاة، هو مرفوض في غير ما تكون عليه في حيّز موضوعيتها، لأن الكلام على الحق يبطل المستنسب، فالمستنسب بهتان وضلال، ولهو الحق الحق دائماً يعلو ولا يعلا عليه. ألم يقل الإمام علي رضي الله عنه: "العدل صورة واحدة والجور صور كثيرة، ولهذا سهل ارتكاب الجور وصعب تحري العدل، وهما يشبهان الإصابة في الرماية والخطأ فيها".
على كل من هذه الظروف الموضوعية، فإن مشكلة تتأتى في الجهة التي تحاكم الوزير وإن التشريع اللبناني يواجه الموضوع عملياً، بعدما واجهه نظرياً في مسوّغات وأسس وتنظيمات مختلفة. وإن الوزير في الدستور هو حاكم، عملاً بأحكام المواد 17، 65، 66 من الدستور، إنه يمارس الحكم في إطار القوانين المرعية الإجراء، ويمارسه في إطار من النزاهة، والترفع والموضوعية، فهو إذن قاضٍ.
والوزير إنسان يقع، يخطئ ويرتكب، فمن الجهة التي تتولى أمور محاكمته؟ إن في لبنان نصوصاً، وفي حيز هذه الدراسة التي يضمّها هذا الكتاب، نصوصاً، ونيّة للمشترع وأصولاً للمحاكمات يعرضها المحامي نقولا ميشال فتوش في دراسته هذه.
