Book Description
يهدف قانون الإجراءات الجنائية إلى ضمان التطبيق الفعال لقانون العقوبات وضمان الحرية الشخصية للمتهم وكفالة تعويض المجني عليه. ويقع على القضاء مهمة حسن تطبيق القانون من خلال نصوص قانون الإجراءات الجنائية.
ولما كان أسلوب التعليق على النصوص التشريعية إنما يرمي وبالدرجة الأولى إلى شرح تلك النصوص وهي بذاتها المهمة التي تدور حولها كل المؤلفات الفقهية، فضلا عن أن تقديم النص معلقا عليه بآراء الشرح وأحكام محكمة النقض يتيح الإلمام بالفهم الذي لقيه في التطبيق بما يلقي الضوء على مواطن القصور فيه أو الحاجة إلى تطويره.
لذا فسوف نتعرض بمشيئة الله وعونه لشرح نصوص مواد قانون الإجراءات الجنائية مادة تلو الاخرى كما جاءت بالتشريع المصري شرحا موجزا غير مخل تارة وبإسهاب غير ممل تارة أخرى. ثم نعقب بعد شرح كل مادة بما استقرت عليه احكام محكمة النقض منذ تاريخ إنشاءها حتى عام2004. ثم نورد تعليمات النيابة العامة ذات الصلة. ولقد قصدنا بالطريقة التي اتبعت في إخراج هذا العمل أن نحقق أملا هو أن يجد القارئ ما يريده.
