يباشر القضاء الجنائي وظيفته بتطبيق قواعد الاجراءات الجنائية وفق نظرية إجرائية منضبطة تفسر له الأحكام الإجرائية، وتعينه على مباشرة اختصاصاته على الوجه الصحيح، وتؤدي به إلى إصدار قراراته وأحكامه في شكلها القانوني السليم جنباً إلى جنب مع تطبيق أحكام القانون الموضوعي الذي يقرر حق الدولة في العقاب.
إن مرحلة المحاكمة والطعن في الأحكام هي التي تجسد روح القانون وارادة المشرع في الحقيقة القانونية الواقعية. وفيها تصير قوة القانون الممكنة قوة فعلية، تقصد إقرار الحق، وتثبيت قواعد العدل، وتحقيق المساواة بين المواطنين.
ويعد هذا الجزء تطبيقا للأسس العلمية للإجراءات الجنائية في مرحلة المحاكمة والطعن في الاحكام. وينقسم الى قسمين: الأول: المحاكمة، القسم الثاني: الطعن في الاحكام. وسوف نتناول مرحلة المحاكمة في بابين: الأول: القضاء الجنائي، الباب الثاني: إجراءات المحاكمة.
