لا يعتبر الشيك عملاً تجارياً إلا إذا حرر بمناسبة عمل تجاري، أما الشيك المحرر بمناسبة عمل مدني فتظل جميع الأعمال التي حرر بمناسبتها مدنية، لكن ذلك لا يعني أنه يظل خارج نصوص القانون، بل إن هذه النصوص تنطبق على كل شيك أيا كان العمل الذي حرر بمناسبته.
ومن المقيد أن نذكر أن قوانين البلاد العربية، سواء قوانين التجارة، ومنها قوانين الأوراق التجارية، متشابهة، خاصة قوانين الشيك، لأنها مأخوذة من مصدر واحد، هو قانون جنيف الموحد… ويلاحظ أن قانون التجارة الأردني الجديد 2005 الذي وضع تنظيماً للشيك في المادة 229 قد نص على أنه "إذا خلا الصك من كلمة (شيك) وكان مظهره المتعارف عليه يدل على أنه شيك، اعتبر شيكاً، وهو وضع غريب، بعد أن عدد البيانات الواجب إدراجها في الصك"
وسنعرض فيما يلي لإصدار الشيك، وتداوله، وضمانات الوفاء به، ثم لوفائه، وأخيراً الحماية الجنائية للشيك.
