نشأت المحكمة الخاصة بلبنان بناءً على طلب الحكومة اللبنانية من منظمة الأمم المتحدة بإنشاء محكمة ذات طابع دولي لمحاكمة جميع من تثبت مسؤوليتهم عن الجريمة الإرهابية التي أودت بحياة رئيس الوزراء اللبناني السابق رفيق الحريري وآخرين ، واستجابة لهذا الطلب تم الاتفاق بين الأمم المتحدة والجمهورية اللبنانية على إنشاء هذه المحكمة بقرار مجلس الأمن الدولي 1757 من العام 2007 .
وإن المحكمة الخاصة بلبنان تمارس ولايتها وفقاً لنظامها الأساسي المرفق بقرار مجلس الأمن رقم 1757 ؛ والذي حدد اختصاصها بالمادة الأولى منه والتي نصت على ما يلي :
ينصب الإختصاص الرئيسي للمحكمة الخاصة بلبنان على محاكمة الأشخاص المسؤولين عن الهجوم الذي وقع في 14 شباط / فبراير 2005 والذي أدى إلى مقتل رئيس الوزراء اللبناني الأسبق رفيق الحريري وإلى مقتل أو إصابة أشخاص آخرين . وإذا رأت المحكمة أن هجمات أخرى وقعت في لبنان في الفترة بين الأول من تشرين الأول / أكتوبر 2004 و 12 كانون الأول / ديسمبر 2005 ، أو في أي تاريخ لاحق آخر يقرره الطرفان ( الأمم المتحدة والجمهورية اللبنانية ) ويوافق عليه مجلس الأمن ؛ وهي هجمات متلازمة وفقاً لمبادىء العدالة الجنائية وأن طبيعتها وخطورتها مماثلتان لطبيعة وخطورة الهجوم الذي وقع في 14 شباط / فبراير 2005 ، أو في أي تاريخ لاحق آخر يقرره الطرفان ( الأمم المتحدة والجمهورية اللبنانية ) ويوافق عليه مجلس الأمن ؛ وهي هجمات متلازمة وفقاً لمبادىء العدالة الجنائية وأن طبيعتها وخطورتها مماثلتان لطبيعة وخطورة الهجوم الذي وقع في 14 شباط / فبراير 2005 ، فتكون المحكمة صاحبة الإختصاص بمحاكمة الأشخاص المسؤولين عن تلك الهجمات .
نستنتج إذن ؛ أن المحكمة الخاصة بلبنان ذات اختصاص رئيسي في محكمة المسؤولين عن هجمات إرهابية متعددة تم ارتكابها في لبنان ؛ الأمر الذي دفعنا لطرح التساؤل التالي :
