يعد كتاب "الدولة وراء القضبان" للدكتورة ترتيل تركي الدرويش واحداً من الكتب التي ازدادت وتيرة صدورها منذ أن دخل المحكمة الجنائية الدولية (نظام روما) حيز النفاذ في الأول من الشهر السابع من عام 2002. ويدور حول مفهوم المسؤولية الدولية الجنائية وتطورها، تثير من خلاله المؤلفة "جدلية مساءلة الدولة جنائياً على الصعيد الدولي".
تأتي أهمية هذا الكتاب من كون إقرار هذا النوع من المسؤولية ليس الهدف منه محاكمة مجرمي الحرب فقط، بل له أهداف أخرى، فبعد إقرار المسؤولية الجنائية للأفراد بقيت المسؤولية الجنائية الدولية للشخص المعنوي (الدول والمنظمات) معضلة وموضوع بحث، حيث اختلف فقهاء القانون الدولي الجنائي في هذا الموضوع، فمنهم من رأى أن فكرة المسؤولية الجنائية للشخص المعنوي غير موجودة بسبب استحالة القيام بملاحقات جنائية ضد الدول لصورة عملية، وعدم إمكانية تطبيق جزاءات جنائية عليها من جهة أخرى، ثم إن تطبيق الجزاء على الشخص المعنوي – في حال انتهاء الحرب مثلاً – سيكون بمثابة انتقام من الطرف المنتصر حيال الطرف المغلوب ... مع العلم أن ما استقر عليه نظام المحكمة الدولية الجنائية، هو المسؤولية الجنائية الدولية للأشخاص، أي مسئولية جنائية يتحمل فيها الفرد الطبيعي مسؤولية تصرفاته المنافية للقانون الدولي.
ونظراً لأهمية هذا الموضوع تم للمؤلفة استعراض كافة الآراء والأفكار المتعلقة بالمسؤولية وتحليلها والمقارنة فيما بينها، ودعم ذلك بتطبيقات تؤيدها وتساهم في توضيحها بالإستناد إلى كلّ من الأحكام القضائية للمحاكم الدولية في عهد عصبة الأمم من جهة، أو عبر قرارات مجلس الأمن في عهد منظمة الأمم المتحدة من جهة أخرى، بإيجابياتها وسلبياتها ...
