مع أن الدراسات والأبحاث التي عنيت بحماية البيئة كثيرة، ومتشعبة في جوانبها العلمية والإنسانية، فإن الجانب القانوني لهذا الموضوع لم يلق اهتماماً كافياً، واتسم بالسطحية، وعدم الوضوح، ومن هنا تأتي أهمية البحث إنطلاقاً من حقيقة أساسية مؤداها أن المكافحة القانونية لتلوث البيئة لا تقل أهمية عن المكافحة العلمية له، إن الحماية الجنائية للبيئة تعد الوسيلة الأكثر فاعلية للحد من الإنحرافات والإنتهاكات المخلة بالتوازن البيئي، ولكي يأخذ القانون الجنائي دوره الفعال في ضمان الحماية القانونية للمصالح المعتبرة عليه أن يواكب التغييرات التي تطرأ على الهياكل الإجتماعية والإقتصادية والعلمية بكيفية تضمن له مسايرة الأنماط المستحدثة في الإجرام، هذا ما يهدف بحثنا إلى توضيحه عن طريق مناقشة وتحليل الحماية الجنائية لعناصر البيئة؛ لبيان فاعليتها في الحد من الإجام البيئي، وتوفير الضمانات الكفيلة لمنع التلوث، وتمتع الإنسان ببيئة نظيفة، لذا سوف تكون خطة البحث على فصل تمهيدي لعرض التأصيل التأريخي للإهتمام بالبيئة الإنسانية، فالباب الأول، سيكون محلاً لبحث ماهية الحماية الجنائية للتلوث البيئي، أما الباب الثاني فسيخصص للأحكام الخاصة للحماية الجنائية للبيئة.
