كان من المفروض أن يصدر الكتاب الحالي قبل مدة طويلة، ولكن تأخر صدروه حتى هذا اليوم لأسباب عديدة، لعل أهمها وفي مقدمتها، أني شعرت بحكم خبرتي واختصاصي في العمل والتأمينات الإجتماعية، أن قانون العمل العماني رقم 34 لسنة 1973 والذي هو موضوع دراستنا في الكلية لفترة من 1999 وحتى 2003 أصبح قديماً بعض الشئ ولم يعد يستطيع البقاء في التطبيق.
وهو الأمر الذي جعلني أراجع نفسي عن جدوى إصدار الكتاب وقانون جديد سيصدر قريب وفعلاً صدر قانون العمل العماني الجديد رقم 35 لسنة 2003، فقمت بتعديل ما كتبته على ضوء القانون القديم، ليأتي منسجماً مع القانون الجديد.
مؤكداً بذلك صحة ما ذكرته للتو أن قانون العمل عصي على الثبات مدة طويلة وأن قواعده تتغير باستمرار مع تغير الظروف الإقتصادية والإجتماعية والثقافية والسياسية، ومدة ثلاثون عاماً منذ القانون رقم 34 لسنة 1973 وحتى القانون الجديد رقم 35 لسنة 2003، كفيلة بأن تحمل في طياتها كثيراً من رياح التغير.
بالمقابل وبذات الوقت صدر قانون العمل المصري الجديدة 12 لسنة 2003 فوجدت الفرصة سانحة لمقارنة بعض المواد في القانون العماني مع القانون المصري الجديد والأردني لتكون الصورة واضحة أكثر.
