يدور موضوع الكتاب حول التعويض في حال الفصل التعسفي عن العمل، وفي القانون يعرف الفصل التعسفي بأنه "يفيد إنهاء عقد العمل من قبل صاحب العمل دون وجود سبب حقيقي للفصل، أو دون إحترام الإجراءات القانونية".
وبما أن القانون المدني يمثل القانون الأم والشريعة العامة فقد كانت ولا زالت علاقات العمل منظمة ضمن أحكام القانون المدني إذ نظمته مجلة الأحكام العدلية والتي لا زالت سارية المفعول إلى الآن في مناطق الحكم الذاتي في فلسطين، في الباب الثاني المعنون "الإجارة على الخدمة".
ونظراً لغياب قانون مدني فلسطيني يواكب التطورات الإجتماعية والإقتصادية، جاء هذا العمل للنظر في عمل مُشرع قانون العمل الذي اعتبرت الكاتبة أنه "لم يأخذ من نظرية التعسف في إستعمال الحق سوى المصطلح القانوني في حين أنه أخذ من نظرية الإنحراف بالسلطة الشروط دون المصطلح".
تأتي أهمية هذا البحث من كونه يدرس بالمقارنة مع بلدان أخرى عربية وأجنبية قانون العمل الخاص بالفصل التعسفي عن العمل من خلال الإجابة عن تساؤلات مثل: هل تبنى قانون العمل قواعد التعويض بكل حزافيرها التي جاء بها القانون المدني ونقله بكل أمانة دون تشوهات أو دون تحسينات؟ أم أنه قام بتطويع أحكام التعويض المنصوص عليها في القانون المدني كما يتناسب مع علاقة العمل؟ أم أنه في إطار بحثه عن خصوصيته لم يتنكر للقانون المدني ولكنه اقترب من فرع آخر من فروع القانون؟.
لذلك اعتبرت الباحثة أن كل هذه التساؤلات وعلامات الإستفهام هي نتيجة حتمية لمعرفة خصوصية علاقة العمل والتي دفعتها للتساؤل أكثر عن خصوصية التعويض عن الفصل التعسفي في قانون العمل الفلسطيني الذي كان له النصيب الأوفر من البحث والتمحيص في هذه الدراسة.
