إن كان الاتجار بالبشر يمثل انتهاكا لحقوق الإنسان، إلا أن تلك الأشكال من التجارة أصبح لها أهداف أخرى تتمثل في توفير وسائل ارتكاب السلوك الإجرامي، وباتت من أهم عناصر الجريمة المنظمة والجرائم الدولية عابرة الحدود في محلها ونتائجها، كالاتجار بالمخدرات، الدعارة متعددة الجنسيات بصورها المختلفة، بحيث يصبح الإنسان مجرماً بواقع الحال بدخوله تلك المنظمات. ففكرة الاتجار بالبشر تقوم في المقام الأول على مضمون استغلال العنصر البشرى في ارتكاب الجريمة، سواء كفاعل أصلى أو شريك مباشر أو بالتسبيب.
وبذلك باتت تلك الظاهرة الاجتماعية تجارة تدر الربح على القائمين عليها من جهة، ومن أخرى باتت توفر العنصر البشرى اللازم لارتكاب الجرائم خاصة المنظمة منها والتي تمارس بصورة احترافية، ويجدر بنا قبل تناول هذه الظاهرة بالدراسة والتحليل أن نسجل ثلاثة ملحوظات مهمة تتعلق بهذه الجريمة، وهى: تعتبر هذه الجريمة من الماضي، حسبنا انه تم القضاء عليها، عادت للظهور من جديد في عصرنا الراهن وبصورة أشد قسوة، بحيث صارت تحقق إرباحا جعلها ثالث تجارة غير مشروعة تحقق إرباحا بعد تجارة السلاح والمخدرات. أن الحروب التي شنتها الدول الغنية ضد الدول الفقيرة تحت مسمى الضربات العسكرية الوقائية بحجة محاربة الإرهاب كما حدث في أفغانستان والعراق ومن قبلها الصومال وغيرها، شاركت بصورة فعالة في تفاهم هذه الأزمة الإنسانية، إذ خلفت عشرات الألوف من البشر المستعدين لبيع أنفسهم كعبيد لتجار البشر يتم استغلالهم في أسوأ أشكال الاستغلال، إن هناك صورا لم تكن معروفة في الماضي جعلت جريمة الاتجار بالبشر أشد قسوة وخطورة، ففي الماضي عرفت العبودية والعمل والسخرة والدعارة كصور من صور النشاط الإجرامي لجريمة الاتجار بالبشر، أما اليوم فان التطور العلمي الذي يشهده العالم اليوم أضاف جريمة حديثة أشد قسوة هي جريمة الاتجار بالأعضاء البشرية.
وعلى هذا، تنقسم هذه الدراسة إضافة إلى المقدمة، إلى خمسة فصول وملاحق، هي: الفصل الأول.. الاتجار في البشر: التعريف والعناصر والأسباب، الفصل الثانى.. الاتجار فى البشر: الصور والأنماط، الفصل الثالث: الاتجار في البشر.. الآثار والتداعيات، الفصل الرابع: جهود مكافحة جرائم الاتجار بالبشر، الفصل الخامس: الرؤية والإستراتيجية، الملاحق.
