يُعدُ موضوع الإتجار بالبشر من أهمّ المواضيع الحساسة والمهمّة في الوقت الحاضر، كونه يُعدُ شكلاً من أشكال الرِّق المُعاصر، وإنتهاكاً صارخاً لحقوق الإنسان وحُرياته الأساسية، وعدِّها من الجرائم التي تُثير قلقاً وهاجساً عند الدول، نظراً لطبيعتها التي تَتّسم بخصائص (السرية والتنظيم).
هذا بالإضافة إلى إنتشار هذه الجريمة بصورةٍ مُخيفة في السنواتِ الاخيرة في العالم بشكلٍ عام، والوطن العربي بشكلٍ خاص، نتيجة للحروب والازمات التي عصفت بالبلدان العربية ولا تزال، وهذا ما أكّدته مُعظم التقارير السنوية الصادرة عن المنظمات الدولية ذات الشأن.
إنّ هذا الموضوع لم يبحث به بشكلٍ عملي مُفصّل ودقيق في إطار القانون الجزائي، فجُلّ الدراسات انصَبّت على بحث جريمة الإتجار بالبشر في إطار القانون الدُوَلِيّ، على عّد أنّ هذه الجريمة ذات أساس دُوَلِيّ، وأنّها تتماثّل نوعاً ما مع الجريمة المُنظّمة عِبر الوطنية.
على هذا الأساس استفردت الدراسة بمنهجٍ مُغاير عن الكتابات السابقة، بحيث تناولت بالتحليل والمُقارنة لنصوص التجريم والجزاء لجريمة الإتجار بالبشر قبل صدور قوانين مُكافحتها، وبعد صدورها، إذ اتّجهت صوت المنهج المُقارن، والمنهج التحليلي بإتباع أسلوب النقد والتصويب، سواءً لتلك النصوص الواردة في (الإتفاقيات الدُوَلِيّة)، أم تلك الواردة في (قوانين العقوبات)، أو القوانين الجزائية الخاصّة كــ (قوانين مُكافحة الإتجار بالبشر)، أو بقية التشريعات الجزائية أو غير الجزائية ذات العلاقة بصورٍ هذه الجريمة، وقد استعانت الدراسة بثلاثِ دولٍ لتكون محل المُقارنة هي: (العراق - لبنان - مصر).
