لتحقيق الإستقرار في الأوضاع القانونية ومن أجل عدم إستمرار النزاعات أدى ذلك إلى تحديد مواعيد للطعن، وقد وضع القانون للميعاد شروطاً محددة وعدم مراعاة ذلك يعني فوات الميعاد.
وتجدر الإشارة إلى أن هذا الشرط له طابع خاص في حالة دعوى الإلغاء في القانون الإداري كونه قصير جداً في مقارنته بمدد الطعن في القانون المدني لأن القرارات الإدارية يجب أن لا تبقى مهددة بالإلغاء على المدى الطويل، إن الإلتزام بالميعاد ضمانة مهمة للأفراد لأنهم قد يواجهون أحوال طارئة تمنعهم من الطعن بالقرار الإداري ومنها ما يتمثل بالوقف.
كما في حالة القوة القاهرة ووفاة صاحب الشأن أو إصابته بأحد عوارض الأهلية والإنقطاع كما في التظلم ورفع الدعوى لمحكمة غير مختصة والمعونة القضائية، بالإضافة إلى ذلك هناك حالات تؤدي إلى دوام الميعاد، كما في حالة القرار الإداري المستمر والقرارات الإدارية المنعدمة والصادرة بالغش والحكم بعدم الدستورية.
وتوصلت الدراسة إلى نتائج مهمة، من أهمها ضرورة توحيد مواعد الطعن أمام القضاء الإداري العراقي والنص على الحالات التي تؤدي إلى الوقف والإنقطاع بقانون مجلس الدولة رقم 65 لسنة 1979 المعدل.
