على الرغم من اشتراط توافر المصلحة فى جميع الدعاوى بأنواعها المختلفة إلا أن شروط المصلحة تختلف في القضاء الإداري عن القضاء العادي, ومن ذلك انه لايشترط في دعوى الإلغاء أن يكون القرار المطعون فيه والمطلوب إلغاؤه يمس حقا وقع الاعتداء عليه فعلا بل يكفي أن يكون رافع الدعوى في حالة قانونية من شأن القرار المطعون عليه أن يؤثر ولو مستقبلا فيه.
وفي مجال دعوي الإلغاء يختلف الفقهاء في العلاقة بين الصفة والمصلحة فبينما يرى بعض الفقهاء اندماج الصفة بالمصلحة يرى البعض الآخر اختلاف الصفة عن المصلحة مما يحتاج إلى تحقيق العلاقة بينهما.
كما يثور التساؤل حول مدى توافر المصلحة للجمعيات في الطعن بالإلغاء في حالة رفع الدعوى التي تمس بمصلحتها أو المصلحة المشتركة أو الخاصة لإفرادها, وطعون الهيئات العامة, وطعون الأفراد والموظفين, وفي أي منها يقبل الطعن وفي أي منها لا يقبل, والطعن على قرار دمج الجمعيات أوحلها.
كل هذه الاستفسارات وغيرها مما سنتعرض له أثناء البحث تشكل محورا أساسيا في البحث في شروط المصلحة في دعوى الإلغاء من حيث تشكل بمجموعها السؤال الأساسي لمشكلة البحث بما يلي: (ما هي حقيقة شرط المصلحة في دعوى الإلغاء) والذي سيكون عنوان دراستنا كما تشكل هذه الإستفسارات المشاكل الفرعية المختلفة والمتفرعة عن مشكلة البحث الرئيسية.
أما خطة البحث فقد قسمنا بحثنا إلى خمسة فصول: الفصل الأول: الأحكام العامة لدعوى الإلغاء, الفصل الثاني: طبيعة المصلحة, الفصل الثالث: أحكام وجود المصلحة, الفصل الرابع: خصائص المصلحة, الفصل الخامس: المصالح التي تبرر قبول دعوى الإلغاء.
