يسبغ القانون حمايته الجنائية علي شخصية الإنسان في كافة مظاهرها, سواء ما تعلق منها بالعناصر الطبيعية (كما في خلق الإنسان في الحياة وسلامة البدن وهي التي تكون جرائم القتل ومختلف جرائم الإيذاء).
أو ما تعلق بالعناصر المعنوية في هذه الشخصية (كما في الشرف والأعتبار وحرية الإنسان.... إلخ) أو ما تعلق بالعناصر المالية.
أو جرائم الأعتداء علي المال التي كان يعتبر الفقه القديم المحل القانوني لهذه الجرائم هو (الذمة المالية) للمجني عليه ولكن حديثاً فإن المشرع يعتبر الآن (حق الملكية) هو قصد المشرع من الحماية القانونية في جرائم الأعتداء علي المال, أي الأعتداء علي محل هذا الحق أي علي ذات المال الذي ينصب عليه حق الملكية, كما أن هذا الأعتداء لا يكون جريمة من جرائم السرقة أو النصب أو خيانة الأمانة أو ما حكمها إلا إذا ورد علي نوع معين من أنواع الملكية, وهو نوع الملكية الثابتة لشخص آخر غير المعتدي علي مال منقول من أجل هذا لأنجازي الفقه التقليدي في التعبير عن هذه الجرائم بجرائم الأعتداء علي المال, والحق أن الأسم القانوني لجريمة من الجرائم لابد أن يشتق أساسه من المال (المصلحة) محل الحماية الجنائية.
