إن الموظف العام هو أداة الإدارة في إدارة المرفق العام، وهو الوسيلة التي عن طريقها يسير المرفق العام. ولكي يستطيع الموظف العام بالقيام بالواجبات المكلف بها، لابد أن يتمتع بالحقوق، وهذه الحقوق هي التي تشجع الموظف العام للقيام بالواجبات المكلف بها، وهذه الحقوق، قد تكون مادية أو أدبية أو غيرها. مثل الحق في الراتب والحق في الترقية والحق في الأجازات والحق في الإستقالة وغيرها من الحقوق التي يتمتع بها الموظف العام. ويقابل هذه الحقوق سالفة البيان واجبات على الموظف العام، لكي يستقيم إدارة المرفق العام وهذه الواجبات الواردة في قانون العاملين المدنيين بالدولة رقم 47 لسنة 1978 وتعديلاته ليست على سبيل الحصر وإنما هي على سبيل المثال وهي التي تناولتها المادتين رقمي 76، 77 من القانون سالف الذكر. وبناءاً على ذلك سوف نقسم هذا الكتاب إلى: (مبحث تمهيدي: ماهية الموظف العام، الفصل الأول: حقوق الموظف العام، الفصل الثاني: واجبات الموظف العام).
