إن مشكلة الاستخلاف الدولي تظهر عند حدوث تغيرات في السيادة عندما يصبح إقليم دولة تابعًا لدولة أخرى. وهذه المشكلة في غاية الصعوبة والتعقيد وخاصة أن الأحداث المؤدية إلى ظهورها تجمع بين عناصر قانونية وأخرى غير قانونية يصعب تقديرها علاوة على أن أي محاولة للتطرق إلى هذا الموضوع تقتضي تحليل الطبيعة القانونية للدولة.
لذا فإننا سوف نعرض لهذه المشاكل وبيان حلولها في ضوء ما استقر عليه الفقه والعمل الدوليين وكذلك ما جاء بأحكام المحاكم وكذلك ما أقرته اتفاقية فيينا للاستخلاف الدولي بشأن المعاهدات الدولية لعام 1978م. وبناء على ذلك سوف نقسم الكتاب إلى: فصل تمهيدي نتناول فيه الجوانب القانونية للاستخلاف الدولي ثم نقسمها إلى بابين: الباب الأول: أسباب الاستخلاف الدولي, الباب الثاني: أثر الاستخلاف الدولي على المعاهدات الدولية في ضوء اتفاقية فيينا لعام 1978م.
