يتضمن هذا الجزء من شرحنا لأحكام القانون التجاري شرحاً وافياً لأحكام الأوراق التجارية والعمليات المصرفية التي وردت في الكتابين الأول والثاني من قانون التجارة الأردني رقم 12 لسنة 1966. وعلى ذلك سنبحث الموضوعات التي نتناول شرح أحكامها في هذا الجزء من مؤلفنا في قسمين: القسم الأول نخصصه لدراسة أحكام الأوراق التجارية التي نظم أحكامها قانون التجارة الأردني في الكتاب الثالث والتي اقتبس أحكامها من اتفاقيات جنيف الموحدة بشأن الأوراق التجارية، فحقق بذلك تقدماً في مجال القواعد التي تحكم هذه الأوراق تيسيراً للتعامل بها في نطاق التجارة الدولية. والقسم الثاني نخصصه لدراسة أحكام بعض العمليات المصرفية التي نظم أحكامها الباب الخامس من الكتاب الثاني من قانون التجارة الأردني، أما العمليات المصرفية التي لم يرد لها ذكر في هذا الباب فسنقوم بدراسة أحكامها وفق ما تضمنته القوانين المقارنة وما استقر بشأنها من أعراف دولية، باعتبار أن العمليات المصرفية أوجدها وطور قواعدها العرف المصرفي.
