تحتل الأوراق التجارية الصرفية والعمليات المصرفية مكاناً مهماً في التعامل سواء أكان من قبل محترفي التجارة أم من غيرهم. بل أصبحت تمثل جزءاً من الثقافة العامة، فمن منا من لم يتعامل بالشيك أو الكمبيالة مثلاً؟ ومن منا من لم يراجع بنكاً؟
كما لوحظ ظهور أدوات جديدة في التعامل وهو البطاقات بأنواعها كبطاقات الصرف الآلي وبطاقات الماستركارد والإكسبريس كارد وغيرهما. فهل يا ترى ظهور هذه الأجيال تؤثر سلباً على التعامل بالأوراق التجارية التقليدية؟ وقد يثور السؤال لماذا تم بحث موضوعي الأوراق وعمليات المصارف معاً؟
ويكمن الجواب في الترابط الوثيق بينهما، فالشيك وهو يمثل مرتبة رئيسة هو الدليل الواضح على هذه العلاقة، فقانون التجارة يشترط أن يكون المسحوب عليه في الشيك مصرفاً كما يعاقب كل من سحب شيكاً على غير مصرف بموجب مادته (275/1).
كما أن السفتجة والكمبيالة تمثلان كماً مهماً في نشاط المصارف سواء أكان ذلك في مجال التعامل التجاري الدولي أم المحلي. وتوجد في المكتبات مؤلفات في هذا الموضوع وكلها اتبعت سياسة المشرع في تناول السفتجة أولاً ثم الكمبيالة وأخيراً الشيك.
ومن خلال تجربتي في التدريس منذ سنة 1970 لاحظتُ أن الدارس يجد صعوبة في تقصي المعلومة واستيعابها عند اتباع هذا النهج في التدريس لأن معظم الفصل لا يدرس ولا يسمع سوى السفتجة وعندما يصل إلى موضوع الكمبيالة لا يجد سوى الإحالة إلى ما درس في موضوع السفتجة وقرب نهاية الفصل يبدأ بدراسة الشيك في حين لو تم بحث المواضيع الثلاثة في آنٍ واحد سهل الأمر على الطالب والباحث لأنه سيعرف الأحكام المشتركة والخاصة بكل منها كما يسمع الطالب طيلة مدة الدراسة بالمصطلحات الدارجة والمشهورة كالشيك والكمبيالة بخلاف الأمر عند الاقتصار على تناول السفتجة والتي لا يعرفها الجمهور مثلما يعرف الورقتين السابقتين.
