يتناول هذا الكتاب عقد يكاد يكون حديثاً مقارنة بالعقود الأخرى ليس سوى إلا لأن الوسيلة المعتمدة في هذا العقد متمثلة بالطائرة... ولهذا بات واضحاً أن عقد النقل الجوي التجاري لإلتصاقه بهذه الوسيلة فقد اتسم بالصفة الدولية وهذا يرجع إلى السرعة الفائقة للطائرة كأداة والتي تتجاوز الحدود السياسية بين الدول وعليه أصبح النقل الجوي من الأركان الأساسية التي يعتمد عليها النشاط التجاري نتيجة إرتفاع وتيرة الإهتمام الكبير في هذا النوع من النقل سواء كان في مجال شحن البضائع أو نقل المسافرين وقد أضافت سيادة السلامة الجوية والانظمة الإلكترونية للأنظمة الملاحية الجوية بعداً آخر في تصاعد الإهتمام بالنقل الجوي التجاري.
كما أن القانون الجوي الذي يحكم هذا النوع من النقل قانون أصيل ومستقل كما أنه قانون ذو اهمية سياسية وإقتصادية خاصة نظراً لما للطيران من أثر في تقوية إمكانيات الدول الكبرى والصغرى على حد سواء، ورغم هذه الإمتيازات فإن هذه الوسيلة محفوفة بالمخاطر مما دفع بالمجتمع الدولي إلى التدخل من أجل تكوين قواعد خاصة تنظم حركة وإستعمال الطائرة وذلك بوضع قواعد ملزمة تكفل سلامة هذه المركبة بما فيها ولهذا لجأت الدول إلى سن تشريعات وطنية وعقد مؤتمرات دولية لوضع إتفاقيات دولية تهدف إلى تنظيم الملاحة الجوية وإستغلال المجال الجوي بشكل واسع.
وهكذا كانت الخطوات الأولى لعقد إتفاقية دولية توحد قواعد المسؤولية لهذا النوع من النقل فكانت إتفاقية وارشو لعام 1929 هي البذرة الأولى التي وحدت هذا النموذج من النقل وتلتها إتفاقيات أضافت وعدلت فيها مواكبة للتطور التكنولوجي في هذا المجال.
